These Terms of Use ("Terms") govern your access to and use of www.verifydiagnosis.com (the "Site") and the radiology second-opinion services offered by VerifyDiagnosis ("VerifyDiagnosis," "we," "us," or "our"). By accessing the Site or submitting a request for a second opinion, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Site or our services. If you are using the Site or requesting a review on behalf of another person — for example, as a parent, guardian, or caregiver — you represent that you are authorized to do so and that you accept these Terms on that person's behalf as well as your own.
Nature of Our Service
VerifyDiagnosis connects you with board-certified radiologists who provide an independent second-opinion review of existing medical imaging, such as MRI, CT, X-ray, Mammogram, Urogram, and DMX studies. We review the imaging and report you already have — we do not perform new imaging studies, and we do not provide ongoing clinical care, diagnosis, or treatment.
A VerifyDiagnosis second-opinion report is intended to supplement — not replace — the relationship between you and your treating physician. It is a tool to help inform a conversation with your doctor, not a standalone basis for medical decisions.
Not for Medical Emergencies
VerifyDiagnosis is not an emergency service and is not designed for urgent or time-critical medical situations. Our standard turnaround time is approximately 3 days (72 hours), which is not appropriate for conditions requiring immediate attention.
Call your local emergency number, or go to the nearest emergency room, immediately. Do not use VerifyDiagnosis, or wait for a response from VerifyDiagnosis, in place of urgent or emergency medical care.
Eligibility & Your Responsibilities
To use our services, you must be at least 18 years old, or be a parent or legal guardian submitting a request on behalf of a minor or dependent in your care. By submitting a request, you agree to:
- Provide accurate information. Including your contact details and a true description of the imaging and report you are submitting.
- Provide imaging you are authorized to share. You confirm that the imaging and reports you submit are your own, or that you have the legal right and authorization (such as parental or guardian authority, or a valid medical power of attorney) to submit them on someone else's behalf.
- Use the service lawfully. You agree not to use the Site or our services for any unlawful purpose, or in a way that could damage, disable, or impair the Site.
- Maintain confidentiality of your own access. If we provide you with any login credentials, portal access, or secure links, you are responsible for keeping them confidential.
Submitting Imaging & Reports
When you request a second opinion, you will be asked to provide your existing imaging (such as a CD, DICOM file, or portal download) along with the original radiology report. We rely on the completeness and accuracy of what you provide; an incomplete study or a report missing important context may limit the thoroughness of the second-opinion review.
We make reasonable efforts to handle submitted files securely, as described in our Privacy Policy, but you acknowledge that no method of electronic transmission or storage is completely free of risk.
Turnaround Times
We aim to deliver a written second-opinion report within approximately 3 days (72 hours) of receiving complete imaging and the original report. This is a target, not a guarantee — actual turnaround may vary depending on the complexity of the case, the completeness of the materials provided, specialist availability, and other factors outside our control. We will let you know if we expect a delay beyond our standard turnaround time.
Fees & Payment
Any fees associated with a second-opinion review will be communicated to you before you are charged. Where applicable, payment terms, refund eligibility, and cancellation policies will be presented at the time of booking or invoicing. If no separate fee schedule applies to your request, no charge will be made without your prior knowledge and agreement.
Intellectual Property
The Site, including its text, graphics, logos, design, and underlying code, is owned by or licensed to VerifyDiagnosis and is protected by applicable intellectual property laws. You may view and use the Site for your own personal, non-commercial purposes, but you may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written permission.
Your second-opinion report is provided to you for your personal use, including sharing it with your treating physician or other healthcare providers involved in your care.
Disclaimers
The Site and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, VerifyDiagnosis disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that a second-opinion review will detect every possible finding, or that it will always reach a different conclusion than the original report.
- We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.
- Reviewing radiologists exercise independent clinical judgment; VerifyDiagnosis does not guarantee any particular outcome, diagnosis, or result from a second-opinion review.
Limitation of Liability
To the fullest extent permitted by applicable law, VerifyDiagnosis and its officers, employees, contractors, and affiliated radiologists will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or our services — even if we have been advised of the possibility of such damages.
Where liability cannot be fully excluded under applicable law, our total aggregate liability arising out of or relating to these Terms or our services will be limited to the amount you paid to VerifyDiagnosis for the specific service giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.
Indemnification
You agree to indemnify and hold harmless VerifyDiagnosis and its officers, employees, contractors, and affiliated radiologists from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Site or our services, or your violation of any law or the rights of a third party.
Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by VerifyDiagnosis. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party site you visit.
Governing Law
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the courts located in the jurisdiction in which VerifyDiagnosis operates, except where applicable law requires otherwise.
Termination
We may suspend or terminate your access to the Site or our services at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to VerifyDiagnosis, other users, or third parties. Provisions of these Terms that by their nature should survive termination — including disclaimers, limitations of liability, and indemnification — will continue to apply.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site or our services after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
